Welcome to Infographics Maker. These Terms of Service ("Terms") govern your access to and use of the Infographics Maker website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

Infographics Maker is an AI-powered service that transforms text content into visual infographics. Users can paste text from blog posts, articles, reports, or other content and generate AI-created infographics in various styles, including Editorial Ink & Wash, New Yorker Cartoon, Minimalist Line Art, Flat Vector, Hand-drawn Sketch, and Isometric Tech.

The Service uses artificial intelligence technology (Google's Gemini) to generate images. Results may vary, and we do not guarantee any specific outcome or quality level for generated infographics.

2. Account Registration

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your account credentials secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. By creating an account, you represent that you are at least 18 years of age.

3. Subscription and Payments

The Service operates on a subscription-based system with monthly generation allowances:

• Free tier: 3 infographic generations per month
• Pro tier: 50 infographic generations per month for $10/month
• Generation allowances reset on the 1st of each month
• Unused generations do not roll over to the next month
• If generation fails due to a system error, your generation credit will be automatically refunded

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are listed in USD and may be subject to applicable taxes based on your location. You may cancel your subscription at any time; access continues until the end of the current billing period.

4. User Content

You retain ownership of any text content you submit to the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to use, process, and store your User Content solely for the purpose of providing the Service to you.

You represent and warrant that:

• You own or have the right to use all User Content you submit
• Your User Content does not violate any third party's rights, including intellectual property rights and privacy rights
• Your User Content does not contain illegal, harmful, or objectionable material

5. AI-Generated Content and Ownership

Infographics generated by our AI ("Generated Content") are created based on your User Content. Regarding ownership and usage rights:

• Free tier users may use Generated Content for personal, non-commercial purposes
• Pro tier users receive full commercial usage rights to all Generated Content created during their subscription
• You may use Generated Content for presentations, social media, blogs, marketing materials (Pro tier), and sharing
• We do not claim ownership over your Generated Content
• You are responsible for ensuring your use of Generated Content complies with applicable laws

Note: AI-generated images may occasionally produce unexpected or imperfect results, including minor text errors. We do not guarantee that Generated Content will meet your specific expectations.

6. Prohibited Uses

You agree not to use the Service to generate:

• Sexually explicit, pornographic, or obscene content
• Violent, graphic, or gratuitously gory content
• Hateful content targeting any group based on race, ethnicity, religion, gender, sexual orientation, or disability
• Content that is illegal or promotes illegal activities
• Misinformation, disinformation, or deliberately misleading content
• Content that infringes on any third party's intellectual property rights
• Content you do not have the right to use or share
• Spam or content designed to deceive or manipulate

You also agree not to:

• Attempt to reverse engineer, decompile, or extract the AI models or algorithms
• Use automated systems, bots, or scripts to access the Service
• Circumvent any rate limiting, access controls, or security measures
• Resell or redistribute the Service itself
• Interfere with or disrupt the Service or servers connected to the Service
• Violate any applicable laws or regulations

7. Intellectual Property

The Service, including its original content, features, and functionality (excluding User Content and Generated Content), is owned by Infographics Maker and is protected by international copyright, trademark, and other intellectual property laws.

The Infographics Maker name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Infographics Maker. You may not use such marks without our prior written permission.

8. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that defects will be corrected; or that the results obtained from using the Service will be accurate, reliable, or meet your requirements.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Infographics Maker, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Infographics Maker and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. Subscription fees are non-refundable upon termination, though you retain access until the end of your billing period. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Infographics Maker regarding the Service and supersede all prior agreements and understandings, whether written or oral.
